Does the 7 day "cooling off" period apply when buying from abroad?

Hi all,
I bought an item of jewelry online with a small independent company based in the USA last week. I have now decided that actually I would like a different piece of jewelry from her collection. On the website it says there is no refund/returns policy at all, which I stupidly overlooked when buying the item. I paid by debit card. Do I have any rights in this situation or am I left to the good will of the company to hopefully resolve this matter?

When buying from abroad you're subject to the T&Cs of the contract, and/or the law of the country in which the business is based.0

If they are in the USA then its almost certainly the laws of the state in the US that they are incorporated in that apply to the contract and so your UK statutory cooling off period is irrelevant.
US laws tend to be a lot less nanny state than the UK and so offer much lower consumer protection. Ultimately speak to them, if they havent shipped it and its a simple switch or upgrade they most likely wont have an issue with it. If you are downgrading they may be less obliging.0 -
The 7 day "cooling off" period (as you refer to it) in the UK has been 14 days for the last year or so. But of course that doesn't apply to your purchase, I think you're stuck with it and if you don't want it you'll have to sell it yourself.0

Don't forget the VAT and customs charges that you will have to pay to the carrier on delivery of the goods.0

BoP now interprets to prevent others falling for the same.
OP. Purchased a trinket from some trinket store, possible like Breakfast at Ti*****'s. It is based abroad. They want to know if UK law applies.
No. Good luck!0 -
