Hi guys! I got a quick question. On the 26 of december i was staying at my friends house my car was parked outside his flat in a bay parking. Around 7 in the morning
A drunk driver crashed in to the back of my car. Police arrived at the scene arrested the the driver.i heared the bang came outside. They gave me his details and told me that he is insured. Now i have made a claim on to his insurance and the guys who are dealing with my claim called me and said that third party insurer is not accepting the liability but they will get the money for my car etc and told me not to worry. It wasnt myfault or anything this idiot crashed in to my parked vehicle which is worth 30k. They said its a total lost . I dnt know what to do now im a bit worried perhaps some of u guys could guide me a little. Thanks

    How old is your car?
  • Thanks for the reply! If he is insured then why his insurance not accepting the liability and refusing to pay even thou all the evidence was there and police also arrived at the scene. Thats my concern

What often happens is the driver ignores all correspondence from his Insurers hoping it will go away. Their Insurers try and a number of times to contact their client to establish their side of the facts.

Are you going to answer how old your car is?

I was asking as if it was new eg under 12 months old you would have been better claiming from your own Insurer
  • Hi! I got a call today from one of my people dealing with my car claim. They said the car that got crashed in to my vehicle was stolen and third party is now denying to pay me. What will happen next ?

If there is no liability on the third party insurer, then you either pay yourself or make a claim on your comprehensive policy

If the guilty driver has any funds your insurer can try and get him to reimburse them, in which case your claim would become a no fault claim, you could pursue him for your excess and your lost NCD would be reinstated.

First I'd speak to the officer dealing with the crash. The suspect will have been interviewed the following morning so you'll need to find out what he said. If he denied driving then this maybe the start of the game. You will need to find out the following.

Is the suspect the registered keeper and insured?
    Has he admitted to driving?
    Has he named the driver?
When was it reported stolen to the police?

Identification is an issue, can you still identify him? What are the police doing about the ID issue?

Can you claim from MIB in these circumstances?
