That is a good point too that has just been made above by another poster - ie what happens about communal maintenance (eg if the roof needs attention)? From a different pov (ie living in house unadopted road) I'm coming to appreciate just what a headache that can be if one or more other parties involved aren't fair-minded etc.0 -
With regards the plumbing, it's not as easy as just getting your insurance company involved. My tenant called me as there was a leak in the ceiling, it was the washing machine in the upstairs flat. When I called the insurance to enquire they stated if it was wear and tear then it wasn't the neighbours liability. If they had incorrectly fitted or damaged the washer then it was. I think before the insurance would fix anything at the neighbours liability it would need to be proven otherwise the OP would have to pay.
In relation to the freehold/lease, I wonder if it works the way we do it in Scotland. It's a part of the title deeds of my property that I own a sixth of the communal areas etc. Any work deemed necessary can be ordered through the local authority who can force the works via a serious disrepair notice (if the parties haven't agreed) and payment.
