M&S PPI Reclaim

Hi I have just received a letter from M&S re PPI. I had a number of loan and credit card accounts with them over the years and on one account (I was told to take out PPI in order to get the loan and I didn't need it) they found in my favour and are sending me a cheque for £2,332.71. In respect of the chargecard which I took out in store and apparently I ticked the box to say I wanted PPI (I recall being told it would increase my chances of getting credit so I said yes) however they have not found in my favour citing - store assistants don't provide financial advice, I chose ppi by ticking the box?, I met the eligibility criteria and the amount paid under this policy was in addition to your employers benefits and other polices. Apologies for the long windedness of my question but if I applied to the financial ombudsman would I stand a chance of a refund. Any help would be greatly appreciated many thanks

    Possibly. However, they appear to be saying you selected to have PPI and it wasnt sold to you and that if you had to claim, your employer benefits would not prevent the PPI from paying out (if they had, then it would have been unsuitable. As it pays out in addition, that is not a problem).

    So, if you go to the FOS, what exactly would you be disagreeing with M&S about?
