Ace Security Services - Help! I screwed up
Salapanda
Hello everyone
I received a parking ticket from the above named company yesterday.
The reason I received the ticket was because I had requested a parking permit from the porter of the place I was visiting however when I arrived it was not with the post (the permits are posted to the relevant house). I didn't have time to go and see the porter and get another permit so I parked on the basis that I had the landowners permission, the porter later confirmed that he had issued the permit therefore confirming that I had permission to park.
The back of the ticket said that to appeal the ticket I needed to prove that I had permission to park on the land ie I wasn't trespassing so I emailed Ace Security Services (which, having read the NEWBIES thread I can see I shouldn't have done as now they know my name) and enclosed the email from the porter saying the permit was issued.
They've now said that they can't process the appeal without my address and that "The email attached does not confirm your vehicle was authorised to park without a permit, it states you could not find a valid permit therefore, the vehicle should not have parked on the land"
I'm not going to give them my address and after reading the newbie thread I'm regretting even getting in touch in the first place. I thought they'd be reasonable and see that the notice was incorrectly issued which I now realise was never going to happen!
I'd be so grateful if anyone had any advice on what to do next. I've come up with three options but I'm not sure which is the best one:
1. Email Ace back saying that I'm not paying and leave it at that
2. Email Ace back and continue to try and get them to cancel the notice
3. Email the DVLA with evidence that I was not trespassing on the land and request that they don't release my details to Ace (I gather they're not supposed to unless there is cause for wrongdoing)
Kind regards
Anna

you certainly did "screw up" , trying to justify your actions, so stop doing it and IGNORE ace from now on
sometimes , doing nothing is the best option, especially with these parking scumpanies, so stop rushing , act in haste and repent at leisure - when you are in a hole , stop digging !
do not do any of the actions you mentioned, the DVLA will do whatever they wish, certainly not what you wish, except at the moment they may not give out your details, but telling them not to do so will have no effect whatsoever
as these idiots dont have your address, or the Registered Keepers details , keep it that way
so IGNORE them , dont respond, dont try and justify anything, not unless you ended up in court, then justify it to somebody who can help you, namely, a JUDGE0 -
None of the above!
Just wait to see what happens. Ace are not members of an Accredited Trade Association and should not be able to access your details from the DVLA (why do you think they are asking you for your address?). I say 'should not', but they have been getting some DVLA data by a back door route.
The outcome of a Judicial Review, which will determine if non ATA organisations like Ace can legitimately access DVLA data, is due today. So please hold on until later today, then we can give you more advice.
To check on progress of the case, look here:

@Salapanda. All clear to ignore this lot now - unless they obtain your address and write to you. Come back if that's the case! Please note, we are not a legal advice forum. ok , as posted on another thread the DVLA were taking the !!!! about 2 weeks ago saying
"
It is DVLA’s policy that companies like Ace Security, who pursue motorists for alleged trespass damages using DVLA data, should be a member of an ATA. Such membership would ensure that a code of practice was followed that contained requirements on matters such as signage, charges and access to an independent appeals service.
However, I must advise that DVLA’s policy in relation to requiring companies such as Ace Security to join an appropriate ATA is currently subject to a Judicial Review.
Until the Judicial Review has been concluded, DVLA is unable to insist that companies that issue charge notices for alleged trespass on private land join an appropriate ATA. Therefore the Agency must continue to consider requests for data pending the outcome of the Court hearing.
I can confirm that a manual request was made by Pace Recovery & Storage Ltd trading as Ace Security on the x xxx for an alleged trespass incident on the xx xxxx 2015 at xxxxxxxxxxxxxxxx
As there is a legal gateway for the release of information from the DVLA vehicle register disclosure in these circumstances does not breach the Data Protection Act and the Information Commissioner’s Office is fully aware that data held on the DVLA’s records is released in this way. I should clarify the membership of an ATA does not itself satisfy the requirement to demonstrate reasonable cause. The requirement is a further safeguard, additional to the need for reasonable cause to be demonstrated to support the provisions of vehicle keeper information."
as the results of the judicial review was published this morning , it would be interesting to see if they now pass on your info.
do nothing , sit back BUT if the guy writes to you , come back , as this is now done and dusted DOOR SHUT!!!!0 -
At least they don't have your postal address - all you will get is begging emails!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD0 -
HOWEVER , this will be a good test of the value of the DVLA , they received official paperwork saying that they had not to divulge date , lets see if they act on it!
IF the OP is contacted by mail , then this needs addressing VERY deeply!!!0 -
I'll update if I receive any post from them. Thanks again for the advice everyone.0
