What happens to the car?

I don't know if this is the right place, but a long story cut short is that I bought a car from a dealer which was misadvertised. The dealer refused to accept it back and it ended up going through the court system, which I won judgement on by default as he didn't enter a defense.

Now, I've applied to move this to HCEO's, but my question is, what happens to the car?

I've not been using it, and to be honest, it's caused me quite a difficult time in not doing so. I did ask the HCEO office, and they basically said that as the court order didn't state otherwise, then ownership remains with me.

I know the proper thing to do is to return it upon receipt of payment, but i feel like being bloody minded and telling him to take me to court for it's return!

Of course, there's still no guarantee that the HCEO's will get my money back for me....

It was a mileage and service history issue, the car is perfectly useable (if you don't count the random cutting out).

The temptation to use it is great, especially as I'm still forced to tax and insure it.....
I've been through the mill once or twice and come out the other side...

  • Its a case of having to Jim as I'm now the registered keeper of the vehicle and due to having no where to keep 2 cars (the wife has a car too), this one needs to be parked outside the house, on the road.

    In order to stay legal, it needs to be taxed and insured.
    I've been through the mill once or twice and come out the other side...

    If it's still registered in the OP's name and they have no option but to park it on a public road then they must also insure and tax it.

    Can you not park the wife's on the road and sorn the car you rejected?
  • I can move the cars about but in all honesty I wasn't expecting this to get to the court stage and take this long, but it has and it should all be sorted within the next month one way or another.

    Hardly seems worth the hassle of cancelling everything at this late stage.
