No fault accident

I just wondered if any one could offer any advice regarding a no fault accident?
In January, as a named driver on my policy, my husband had a no fault accident when he stopped for a level crossing and someone ran into the back of him. At the scene, the other car was pretty mangled. The 3rd party wrote down his name, number, reg plate, and insurance company, and my husband provided all the same except for his insurance company, as he wasn't sure.
As the other mans car was so badly damaged, my hubby followed the man to his work place to leave his car in their car park, and then drove the man home to the same address that he wrote down.
We reported this to our insurance, and in our naivety, went with Albion assistance for repairs and 3 weeks worth of hire car. Fast forward to now, and Albany recently contacted us to get further information, as the 3 party insurers are claiming that it is a case of mistaken identity, and are refusing to pay out.
i have called Albany and they have said they are waiting for further information regarding the claim for mistaken identity, and that it is reviewed monthly.
I have just googled it and I am now panicking, as although I had an idea that the car hire and repairs were as part of a credit agreement, I thought any car hit from behind is automatically no fault, and that in the case of uninsured drivers, payout would be done by MIB. Is this correct or are we facing a massive bill for repairs and car hire if this isn't settled by the other sides insurers? I remember albany telling me that once fault is established costs would be recovered from the other party, I can't remember any warnings regarding uninsured divers or mistaken identity.
I must add that my husband received text messages the day after the accident from the person who drive into him, asking him not to go through the insurence as he wanted to settle without, but we knew the extent of our damage was too great. He also received a text message a couple of days later saying that the mans insurance was writing his car off. Do you think these will help in the case of ifentifying him?
Also, does this mean we are looking at this hanging over us for years?
Sorry for all the questions. Having not had an accident recently, I had no idea of the minefield we were entering, and now wish I had never gone with admiral/Albany assistance.

    You first thing to establish is, was the other car insured at the time of the accident? If so go to them.

    Basically this is insurance incompetence OR they're dragging their heels deliberately.

    Get on the phone to insurer and tell it to them straight, be assertive, you've even had texts from the other driver so it CANNOT be a mistaken identity and i'm 99% sure if you contacted the third party he'd be as shocked as you. In fact..... Try it.

    Basically they can't be bothered because there's something tricky about the whole claim and they're passing it around the office.

    A few years ago, minor accident, my insurer "lost" my dashcam footage 6 times, LOST SIX TIMES!!!!!! 6 CDs I sent them, 3 by recorded post, all "LOST". I reckon they just knew it wasn't a simple case and couldn't be ar5ed.

    The text messages maybe from the driver who was involved in the accident. Doesn't mean they're from the owner and policy holder.
