Moving Rentals Timing

Good morning :)

Had a bit of a look and can't quite find what I'm looking for and I sure plenty of you have been in a similar position and have useful experience to share.

The tenancy on our two bed house is up in September and as we've recently gone from one child to two we're incredibly keen to move into a three bed house.

So my question is one of timing. Haart will be asking us what we want to do when our tenancy is up. We're expecting them to ask in July. The problem we have is most suitable properties are either available immediately or within a month. With a young family we're not especially keen on giving our notice without having a new house confirmed. Giving the timings we're likely to be in limbo for a month. If any of you have been in a similar position how did you manage it? I've thought about trying to switch to a periodical lease but I'm getting the feeling Haart won't entertain this.

    You have a fixed lease. You owe them rent until september. No if's, no buts (and certainly no coconuts!)

    You can ask to surrender the property. If you want to leave before september.
    Or you can move to a periodic automatically in september. Then give notice and move.

    Are you wanting to move before september?

    If they get in touch in July, ignore them. If you want to get to Septmeber and then start looking.

    OR. Get to july/august, find a property and move before your tenancy ends.

    Sorry, should have clarified - we will absolutely want to honour our existing contract. We just need a bit of advice on managing the letting agent at time of change. What are our rights etc.

    Edit - so we are well within our rights to move to a periodic? This is perfect if so.

    Slightly confused by what you want to achieve, however if it's:

    Come september, not sign a new 12 month contract, and move onto a rolling monthly contract.

    This will happen automatically, by law, as soon as you are there for 1 millisecond past your tenancy.

    e.g. if your tenancy expires on the 2nd september. When you wake up on the 3rd, you will be rolling monthly.

    Guest 101 - that's exactly what I was hoping. Haart were being a bit sneaky when we renewed last time suggesting periodic wasn't an option.

    Letting Agents? Being sneaky? how very dare you?! :rotfl:

    And beware, sometimes they serve section 21 eviction notice. If they do, dont panic and come back for advice.

    Since you want to move anyway, this really isnt that much of an issue.

    You can 'manage' the letting agent by ignoring them! When your fixed term ends you automatically roll on to a periodic tenancy - they can't just turn up and evict you immediately - that is the law.

    Also keep in mind that if you hand back the keys before the end of the fixed term you do not need to give notice (but of course you must pay rent to the end). That might be helpful if you can get the timing on the new place right.
