    11 months is the period of credit under the credit hire agreement, not the length of time the hire will last for.

    The rental agreement will have cancellation rights as it is a consumer credit agreement signed away from the business premises of Albany/ Helphire.

    Odds are, if they try to cancel now, they will be asked to pay the charges incurred so far and possibly also an engineers fee as they will have already instructed an engineer to assess the car.

    They are not working for the broker as such, the broker has just had the claim reported by their policyholder, who will have more than likely confirmed it was their fault, so the broker has decided to make a few quid out of the situation by flogging details of the claim to Albany to provide hire and pay the broker a kick back.

    Hello, i am not using albany, albany is the company my insurance (admiral) wanted me to use.

    Spoke to the company this morning, they are sending my car back and not charging me anything. I asked for something in writing via email but i am yet to receive this. They are also sending my car back on a low loader for some reason even though they drove it away. Not sure whats going on. I explained how i was tricked into thinking they were the third party and they did seem genuinely ok.

    This is all very strange and sounds incredibly dodgy, it's so ar5e backwards that somebody somewhere has got to be taking some cash in hand for this.......

    Credit hire of a car for the non fault driver is widely publicised as being very expensive and very risky. One of the resons why claims are so high.

    Also look at Honest John for more info. You have paid YOUR insurance company to insure YOU and represent YOU in YOUR time of need so use them. Anything else is foolish. remember too that you can get your car repaired where you want not necesarily where your insurance co uses although that often is simpler.

    Thanks for all the help guys, still waiting on documentation, apparently the car is on the way.

    Does anyone know what will happen now if my insurance claim against the third party and also this accident management company claim? Im worried the third party wont pay out to my insurance if this accident management company are also claiming against them. The guy on the phone said they would still be trying to reclaim the costs so far from the third partys insurer.

    I don't agree with this at all. More often than not insurance companies will put their own interests (and costs) before their own customers.

    If you are victim of a non-fault incident then its preferable to claim directly from the TP insurer where possible and there's usually no issue with using an accident management provider as long as you're fully aware of the process and the TP liability is clear cut.

    Personally I'd only claim from my own insurer as a last resort.

    Well, i have my car back! And the hire car has gone back too. Does anyone know if this email from the garage excludes me from owing them payment if they cant recover it? In otherwords does it negate the document i signed which states i may be liable if costs cant be recovered:

    Following our conversation earlier, we are sorry to learn you no longer wish to use our services following your accident.



    Please be advised any services we provide as explained prior to any vehicle being delivered to you are made out in your name, however the charges are not payable by you but redirected to the responsible insurer who caused the accident.



    Hence in this case any hire charges and recovery would be only be liable to be paid by the responsible insurer.



    We trust this email clarifies our stance in this case.



    However if you have any questions please feel free to contact myself.

  • That email is pretty much a side agreement to say you will not have to pay any charges, even though they are made out in your name. It is a collateral contract, as it emphasises terms additional to the written rental agreement, that were explained to you before you entered into the hire agreement and essentially coerced you into entering into the rental agreement.

    Keep that email!
