Case of the mistaken car park

Hi, I have read as much info on here as I can but I have a query about where to go with this POPLA appeal.

I parked at Metrolink car park (Care Parking) and went on the tram, had a few drinks and thought I would pick the car up the next day. Only saw the signs saying free car park for Metrolink customers. I was ticketed over night as apparently you can't leave the car when the trams aren't running. So far, so the same as many on MSE.

But on the ticket it says the car was parked at another station some 10 miles away. I emailed Care Parking to say the car definitely was not in that car park on that night. They refused my appeal and re-iterated it definitely was in the other car park and added link to photos of my car (in the dark with no station defining characteristics in shot) allegedly proving it was at the second tram stop.

So I have my POPLA appeal code and I have the tram tickets from that night showing the actual station I departed from and paid for by card to tie to me personally. I could go to the other station and see if the car park is vastly different that it would show on a night photo.

Would POPLA just allow the appeal just on the fact the car was absolutely not where they said it was thus the particulars were wrong and the 'offence' invalid. There must have be a fault with the computer than night.

Or would I have to do the whole "The car wasn't there but also at the other car park where it was the signs were terrible, no loss incurred etc."

Any help would be most gratefully received.

    If you do all this you are admitting you were the driver.

    use the forum search for metrolink care parking popla appeal and plagiarise one of those other recent popla appeals for guidance (there are many examples to read and choose from)

    if you allege as KEEPER that the contravention didnt happen and the vehicle wasnt there , then they have to prove all the details that they put in their invoice

    but also include

    not a gpeol
    no contract
    poor signage
    not relevant land under POFA 2012

    etc etc too

    use all the ammunition, not just one bullet

    As it was before I was pointed in the direction of this site, I sent the email to Care Parking before they sent me a NTK. Have I compromised my position as the KEEPER v DRIVER already?

    depends if you admitted being the driver or not

    the driver could have passed the details onto the KEEPER, the KEEPER would then appeal

    only you know what was written, so either you outed the driver, or you didnt
  • I did not state whether I was the driver:

    "The PCN states the location my car was parked at was Metrolink Sale. It was not...." is my only reference to the car.

    Hurrah! It would appear that I remain a KEEPER. So pleased I didn't let your brusque tone elsewhere put me off seeking help. Thanks.

    my tone is always brusque, always matter of fact, always to the point, also irrelevant to the info I impart ;)

    (I am not here to make friends, but to let forum members beat these parasites at this "game")

    sometimes parking companies try to give out poor information so that the driver outs themself and argues the toss over it

    I would go with a standard popla appeal , but also allege that the car was never parked in the car park listed on the invoice so the listed contravention did not occur

    the problem with this would be if they then issued a new ticket with the correct details on it , so I am more inclined to major on the usual appeal points because you only need to win on one so any will do

    ie:- you want an end to it, not to score brownie points over the location issue

    its the long game that counts

    I wouldn't do as you propose (ie prove by way of your credit card details which station you parked at that night)


    Just follow the procedure already advised.
