HELP BOND REFUND, HUSBAND ABANDONED ME and how to divorce him...

Married March 2014

moved out of my flat with single tenancy in June 2014

moved into massive town house at his request June 2014, joint tenancy joint bond TDS

caught him messing with my friend end of July 2014

he disappeared 8 Aug 2014, he advised police he was moving out whilst I was in work, as they had threatened to arrest him for criminal damage as he was starting to punch holes in walls.

Have heard nothing from him have no idea where he is his family come from over 100 miles away and he kept me away from them, no contacts

Been paying rent £725 out of my account, only my money since June 2014 beginning of tenancy

lettings agency can't get hold of him nor can I , cannot trace him at all

lettings agency will not pay me back his 50% of the bond say they are keeping it on account and await his instruction

i cannot even get hold of him to go for a divorce

cannot afford to trace him can only just about afford to live

moved into a small flat single tenancy but still struggling

manage to pay all the rent on that house through borrowing off my parents.

what can i do when the lettings agency says they are keeping that £355 of his until they get instructions to either pay him or give his portion to me? say they will only pay me my 50%

also, how on earth do i go about divorcing him when i have no money to find him

help?? :(

    Other posters have recommended Wiki divorce as a site to help with divorce.

    There are loads of tracing agencies that track down ex-tenants (ones owing rent/damages) for landlords to take them to court and their service only costs around £50 or so. Perhaps they also trace absconding joint tenants? Don't know.

    They usually recommend that the landlord waits a few months after the tenant has fled to make it easier to find them, as they rely on the tenant registering their info somewhere else, like on the electoral register or similar (though many bad tenants know how to fly under the radar).

    Do you have any joint accounts or other credit/debt that your ex is currently tied to?

    Shelter will be able to give you expert advice about your rights with regard to the deposit, whether the agent's action is correct.

    The Debt Free wanabee board may be able to help you come up with a better debt management strategy.

    There's a budget planner on the MSE website - download it, populate it, work through the site to identify where you can slash outgoings through the cheapest tariffs, frugal recipes and so forth, then produce a thrifty budget and stick to it.

    I'd start with an appointment with Citizen's Advice

    Regarding the bond -who actually paid it ? Eg whose bank account did it come from ? Shelter will be able to advise you best.

    You may be able to serve divorce papers on him at his parent's address but it'd be cheaper to wait a while and see if he surfaces.

    Hand on heart, this is just an observation and not a judgement. I do hope it doesn't come over as mean. I hope that you can crack the divorce and debt issue.

    However, I had a glance at your last couple of posts from a few years ago and your last fella who earned 35k, who also became un-contactable, left you bankrupt and your property repossessed when you were sick and on benefits.

    You aren't having much luck with money or men? I'm assuming the latest incident was from another bloke.

    The only debt he had was a credit card, but i have the statement but they won't tell me where he is or give me an address. He has obviously changed the address as I no longer get bills coming to the house.

    No joint accounts or joint debts. The only joint thing I did was the tenancy. Thank God.

    Good, if they gave you his details it would be a serious breach of the DPA.

    The above says how to deal with the divorce, unsurprisingly it isnt that uncommon nor difficult.
  • If it's a joint bond, surely the letting agents are within their rights to keep his portion of the deposit until he makes contact. What right do you have over that portion of the bond?

    Even though it was a joint tenancy the OP was liable to pay all the rent not just half .......so by the same logic why would she only be entitled to half the deposit back ?

    If it was two separate bonds you'd have a point - but it apparently wasn't.

    Incorrect.

    There is no his or her portion.

    There is 1 legal tenancy. This is made up of two people. Each person is responsible for 100% of the rent. The deposit is paid by them as a single legal entity, either party may reclaim it.

    If he wants his half back, he can sue the OP for it. The LA (as is usually the case, as ignorant at best, hoping to keep it altogether at worst).
