Viagogo ticket refund

I purchased 2 tickets to see FLeetwood Mac at the Genting Arena last night 9/62015 from Viagogo, the event was cancelled at 6pm as the doors were dueopen at 6.60pm.
we travelled from Devon, booked a hotel and have incurred a lot of cost.
I paid well over the face value to obtain these tickets, they are now rescheduling for the 7th July and we cant attend this due to other commitments.
Viagogo are saying that they will not refund my money as theevent has been resheduled and not cancelled.... but it was cancelled and I cant attend the new date zo I require a refund for the exactamount of money I paid. They advise I can resell, but I wont get the full amount paid out as some one will only pay face value... wont they?

Can you please advise

    Why won't they?

    You paid "well over the face value", so how can you say others won't?
  • Perhaps? If im lucky, but surely my issue is with viagogo, I must have rights to a refund? Do I? They dont think so. Already out of pocket from tavel expences, hotel, time off work (partner self employed so loss of income) I know I wont get that back. People were queing to go in thats how late in the day the gig was cancelled.

    I don't think so.

    From the Viagogo T&Cs:
    viagogo provides a service that allows members who want to buy tickets ("Buyers") to find members who want to sell tickets ("Sellers"). viagogo does not take title to the underlying ticket and the actual transactions are between the Buyers and Sellers.
    It appears that viagogo are only putting the buyer and seller in touch... in a similar way that ebay does.

    If a remedy is due, I believe you should be seeking it from whoever you bought the tickets from.

    Their T&Cs also say:
    6.8 All Sales are Final. All sales and bids are final. No refunds, cancellations or exchanges will be issued for date or time changes, partial performances, or lost tickets.
    Whether that statement is enforcible or not, I don't know.
    I don't know because I know nothing about the laws of Switzerland, and Viagogo's T&Cs do say:
    7.4 Governing Law. This Agreement shall be governed by and interpreted in accordance with the Swiss laws. You consent to the exclusive personal jurisdiction and venue of Swiss courts. viagogo AG is registered in Switzerland, Company No. CH-270.3.014.628-0 with the registered address: viagogo AG, Rue de Lyon 109, 1203 Geneva, Switzerland

    Ive purchased Wireless Festival concert ticket from Viagogo, when I went to the venue they declined and told me it's a fraud ticket and was named MARK KERNESS which is not me. Was annoyed really. Had waited for this event. I called Viagogo, Paypal, ActionFraud and the Police. The Viagogo promised for refund the full amount and a voucher of $20 and theres no use because I wont buy any ticket from them in the future.

    Hope anyone wont be a victim like what I had.

    At one time there was a VERY useful page from Consumer Direct on the same issue; the gist of which was (IIRC) that, should an event be rescheduled the buyer is entitled to a refund if he/she is not able to attend the re-arranged event.

    But that might refer to tickets bought directly from the venue and/or licensed agent and not a third-party seller.

    Which leads one to conclude that if one is paying face value + for tickets, then adding on the cost of travel, days off, hotel accommodation etc insurance starts to look like a very sensible thing to buy...
