    the person receiving the money is in an advantageous position, the clause adds a disclaimer to prevent the recipient from taking advantage and therefore double claiming both a cash settlement AND through insurer.

    Really, how?

    It looks to me that following the repair they will be back in the pre accident position.

    To attempt to claim off both would be fraud.

    If the TP tried to claim off the OP's insurance then they would contact the OP at which point they will say they've already paid him £X and the insurer would consider that when deciding on how to conclude the claim.

    Assuming the TP had a genuine claim for further damages then their insurers MAY reimburse the OP for their original outlay assuming they can substantiate that the monies were paid.

    Whether the terms would stand up or not doesn't take away from the fact op would then have proof of what was paid for and how much.
    such a document combined with a professional report of the full extent of damage could certainly hold its own,PI excepted.
