Being made redundant but the charity still exists and is recruiting

Hi,
got a bit of a humdinger which I would like to get peoples opinion on and maybe some knowledgable information.
Due to the governments great scheme for providing some child care costs preschools are shutting down all over the place.
My wife is being made "redundant" from the local preschool which is charity run.
The children, supplies and the money the charity has raised is all going to the local school who are opening up a pre-school. County council have been involved since day 1 but something doesnt sound right.
If the school are opening up a NEW pre-school why are they being given the money the charity has raised for the old pre-school - we are talking 10s of thousands here! (surely the charity should be defunct as well as the pre-school)
BUT
If the pre-school is being TRANSFERED to the school why were all the staff made redundant?
The pre-school and the charity is either closing or its not - this seems to be a bit of both. (ie. lose the staff, keep the money).
Any thoughts?

Not really unless you ask them the question. There is a question of TUPE here, but unless you can explain the reason they give for your questions, it's impossible to say. So you do need to ask them first. It is possible, but I am not saying it is correct, that the charity has donated the money raised to another similar cause. They are allowed to do this. It is not as clear cut as the charity is closing or not. The money is not the test of TUPE. The reasons why the charity has decided to close the pre-school is the basis for whether there is a TUPE or not.0
