VisitScotland Terms and Conditions

NO PURCHASE NECESSARY TO ENTER OR WIN.

ELIGIBILITY
1.1 Open to UK, CI, IoM and RoI residents only.
1.2 All employees and the immediate families of either VisitScotland (“Promoter”), or its agents or Partners, Fenton Towers, Quality Meat Scotland or anyone professionally connected with the promotion are not eligible to enter.
1.3 To participate entrants must be aged 18 years or over.
1.4 Limit one (1) entry per person.
1.5 This promotion closes on 29/09/2015 at midday for receipt of all entries.
HOW TO ENTER
2.1. To enter log on and register your details. All entrants must have a valid email address.
2.2 Proof of either online submission of entry, or postage will not constitute proof of receipt or delivery. Receipt of entries will not be acknowledged.
2.3. The Promoter or its agencies will not be responsible for the non-inclusion of entries or any claims as a result of being lost, late, illegible, incomplete, invalid, or because of technical failures or otherwise, including such failure which is within the control of the Promoter or its agencies.
2.4 The Promoter reserves the right to require the winner(s) to provide proof of identity, age and residency, as the Promoter may deem necessary. Identification considered suitable for verification is at the Promoter’s discretion.
2.5 Any other attempted form of entry is prohibited. Third party entries, or those made online using bulk methods such as the use of automated devices, processes, or syndicated entries are not allowed, and all such entries will be disqualified. Entrants who purposefully do not give correct details in order to manipulate the promotion will be disqualified. You may not disable, hack or overcome any of our online systems or security features.
DRAW
3.1 One winner will be selected from all eligible entries received by the closing date, 29/09/2015. The draw will be conducted randomly within 28 days of the closing date. By entering the prize draw, entrants confirm that they have read and agree to be bound by these Terms and Conditions, and by the decisions of the Promoter, which are final in all matters relating to the prize draw. Any breach of these Terms and Conditions will result in the forfeiture of the prize.
PRIZES
4.1 One (1) winner will receive the prize. The prize is for 8 people, and the winner will be able to choose seven companions to accompany them on the trip. The prize comprises:
• 7 nights’ accommodation for 8 people on a B&B basis in Fenton Tower, Kingston, North Berwick, East Lothian EH39 5JH.
• 1 x bespoke hamper from Quality Meat Scotland containing specially selected pork sausages, Scottish bacon, Scotch Beef sirloin steaks and leg of Scotch Lamb. Approx. value £100.
• The prize also includes travel allowance up to a maximum value of £100 per person. The Travel allowance will only be reimbursed upon the presentation of invoices/receipts in support of allowable expenditure. This must be sent to VisitScotland within 1 month of taking the trip. The maximum amount of Travel Allowance payable will be at the Promoter’s discretion, and in any event will not exceed £800.
4.2 The prize is available for redemption between the following dates specified only: 01/01/2016 and 29/02/2016 and is subject to availability. The prize must be used in full by 29/02/2016.
4.3 The prize is as stated and is non-transferable, and non refundable. No cash or other alternative is available (in whole or in part), except that in the event of circumstances outside its control, the Promoter reserves the right to provide a similar prize of equal or greater value.
4.4 The prize does not include any travel insurance, or any other meals or related living expenses. All travel, activities, and accommodation are at the winner’s and travel companion’s risk. Transportation to and from the departure point, taxes, fuel surcharge, meals, gratuities, travel upgrades or any other expenses not specifically listed in these Terms and Conditions are the responsibility of the winner.
4.5 Winner(s) and travel companion(s) must travel together, departing from and returning to the same location at the same time and on the same itinerary. The travel companion must be aged 18 years or over, unless the winner is their parent or legal guardian or has the written permission of their parent or legal guardian. The Promoter is not liable for delays, cancellations or unforeseen events related to any travel arrangements.
4.6 Winner(s) and travel companion(s) will be solely responsible for obtaining valid identification and compliance with all travel and health requirements (i.e. passports driving licences) relating to the acceptance and use of the prize package(s). The Promoter will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.
4.7 If the winner is unable to use the prize by the date specified at Condition 4.2 the prize will be forfeited. All activities, travel and accommodation are subject to availability, weather conditions, and are subject to the individual prize provider’s standard terms and conditions, which can be found by contacting each prize provider as specified above at Condition 4.1.
NOTIFICATION
4.8 The winner will be notified in writing by email or post, within 28 days of the closing date. If a winner does not respond within 28 days of first notification attempt, if any prize notification is returned as undeliverable, if the winner does not accept the prize or in the event of non-compliance with these prize draw Terms and Conditions, the Promoter reserves the right to withdraw prize entitlement and the prize will be forfeited and an alternative winner may be selected. Upon prize forfeiture, no compensation will be given.
CONDITIONS
5.1 The Promoter, and all partners and prize providers, and their respective affiliates, agents, successors, employees, officers, directors and assigns are not responsible if any portion of the prize cannot be awarded or used due to travel cancellations, delays or interruptions due to circumstances beyond the Promoter and any prize provider’s reasonable control.
5.2 The Promoter reserves the right to cancel, terminate, modify or suspend this prize draw without prior notice in the event of circumstances arising beyond its reasonable control that makes it reasonably necessary to do so but will use all reasonable endeavours to minimise the effect to participants.
5.3 The Promoter reserves the right to disqualify any person it finds, in its sole discretion, to be tampering with the operation of the prize draw, or the VisitScotland website, or to be acting in violation of these Terms and Conditions.
5.4 The prize draw and these Terms and Conditions are governed exclusively by the laws of Scotland, which shall be exclusively applicable to any and all disputes arising out of or in connection with the prize draw or these Terms and Conditions. The Courts in the part of the UK, CI, IoM or ROI that you are domiciled in shall each have non-exclusive jurisdiction to hear any disputes, provided that the Scottish Courts shall always have non-exclusive jurisdiction to hear disputes.
5.5 The winner(s) will not be required to participate in any publicity arranged by the Promoter or its agencies, but the name and county of the winner(s) will be released under Condition 7.1 upon request.
5.6 Nothing in these Terms and Conditions seeks to restrict your statutory rights as a consumer, or seeks to exclude or limit the Promoter’s or the prize provider’s liability for death or personal injury caused by their negligence or for fraud or any other liability that cannot be excluded by law.
5.7 Subject to Condition 5.6, and subject to its obligation to make the prize available to the winner(s) subject to these Terms and Conditions, the Promoter shall not be liable to the winner(s) or any travel companions in respect of any loss or damage in connection with the use of the prize except where such loss or damage is foreseeable and is directly caused by the fault or negligence of the Promoter. Please see the terms and conditions of the prize provider in respect of the prize provider’s liability to the winner(s) and any travel companions in respect of their use of the prize by contacting the prize provider as specified above at Condition 4.1.
5.8 The Promoter will not be liable to reimburse your costs or expenses incurred in entering the prize draw (if any).
USE OF DATA
6.1 VisitScotland will only send marketing literature by email to entrants who have “opted-in” on the relevant entry form to receive emails in respect of further information from VisitScotland and its affiliates and/or the prize provider and its affiliates. VisitScotland may send marketing literature to entrants by post, but will always provide recipients with an option to “opt-out” of such marketing communications at any time.
WINNER INFORMATION
7.1 To obtain the name and county of the winner send a Self Addressed Envelope to Fenton Tower prize draw c/o VisitScotland, Ocean point One, 94 Ocean Drive, Edinburgh, EH6. 6JH by no later than 3 months after the closing date.
