Parking Charge Notice - Premier Parking Solutions

Hi
I received a Parking charge notice from premier parking solutions today demanding that I pay the standard £100 fine, which is reduced to £60 if paid within 14 days. There is an app associated with Premier Parking solutions called RingGo. I have been using this for a while and have 2 cars registered on the app. I accidentally paid for the parking on the wrong car and subsequently received the parking charge on the car that i was meant to pay the parking for. Do I have a case to refuse the charge and a right to appeal based on it being an "unfair" charge?

There are always grounds to appeal a charge - first to the parking company and then if they reject your appeal to POPLA (as Premier Parking Solutions are a member of the BPA Ltd) where you stand an excellent chance of getting this cancelled.
Have a read of the **NEWBIES!!...... sticky thread for information on the legal arguments to use for an appeal and a 1st appeal template to send to the parking company.
If it was a windscreen notice which is classed as a Notice to Driver and not a postal Notice to keeper - wait for the postal notice to arrive.0 -
First appeal - easy, use the template in the NEWBIES thread. They'll reject, then you get a POPLA code and you won't have said who was driving, which gets you an extra appeal point about 'no keeper liability' if you can show POPLA the flaws in the postal Notice (I assume it was a postal PCN?).
Second stage - come back and show us your draft POPLA appeal which you can copy from other POPLA appeals re PPS. Just search the forum for 'PPS POPLA'.
Then (stage 3) when they send their POPLA evidence, come back here quickly for help to rebut it - IMPORTANT with PPS! You MUST check & rebut their evidence or they could win.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I sent an email to premier parking solutions a few days back stating that I am appealing against the PCN, the mitigating circumstances and why the fine should be revoked, I did however include my name and address which I'm now thinking was a bad idea after reading the comments on this thread. I'm still waiting for a response from PPS0

I used the template but copied and pasted it into an email. The PCN said I could appeal by email, I thought this would be a quicker form of correspondence0

The fact you say you provided your name and address makes me think you appealed against a windscreen notice - is that correct ?
It sounds like you may have dobbed yourself in as the driver - but that will depend on how you phrased the mitigation additions - was it all in the third person - or did you use phrases such as "I entered the wrong reg...".
But don't worry , whilst you may not be able to use the extra appeal point "no keeper liability" in a POPLA appeal, there are plenty of other challenges.
Just wait for their rejection and the POPLA code then draft an appeal as Coupon-mad has advised in post 4 above.
No mitigation in your POPLA appeal though - it's specifically excluded - just the legal arguments you will find in other POPLA appeal examples for PPS0 -

I think you might have done the right thing here. I know we always say mitigation doesn't work but you paid, can prove it and they might just concede this one.
If not, then you still have your independent appeal process where you can use the template points, but suitably edited0 -
