Blackhorse Loan PPI Mis sold at Garage

Options
Please help. . .

I bought a motorbike at a private garage in 2004. . .

The loan was through Blackhorse, and the PPI was sold as part of the loan agreement. . .

I was mis sold the PPI at the garage, as I was told the PPI had to be taken out with the loan. . .

When I complained to Blackhorse, they said they 'were not present at the point of sale, and that they were therefore not liable. ..

But they went on to say that ''if you can provide documentary evidence, they will investigate further. ..

They have then sent out new forms asking for more info. . .

Can someone please confirm if I should pursue Blackhorse, or the garage , for the mis selling of the PPI. . .and for the benefit of others, are their any reasons at all for pursuing the bank if the garage sold the PPI incorrectly. ..

Many thanks in advance,

David.

    The garage sold it.

Any liability sits with the seller.
  • I bought a car at a garage. I wrote to them and they said the same to me. I took it to the ombudsman and they have just found in my favour and Blackhorse are having to pay out. And this was from 2002

This is not the case. Blackhorse are responsible. I have just been paid out in the same situ

    It is the case.
The seller is responsible, not the provider, unless a direct link can be found between the two.

Agree with -taff & PeacefulWaters the seller of the insurance is the body responsible and the OP clearly says the dealer sold him the PPI. If its true what Stuart1979 says, there must be some particular reason why the FOS have found Black Horse liable in his case, perhaps he approached Black Horse himself directly for the loan or Black Horse sold him PPI via a follow up phone call after the loan was in place or maybe Black Horse included PPI in error even though the neither the garage or he asked for it or as -taff suggests, some direct link has been found.

It would be very helpful if Stuart1979 could come back and tell us exactly why FOS have found Black Horse responsible, this information should be in the decision letter because it appears that Black Horse defence of the claim was that it was nothing to do with them. This info would be very helpful to others in the same boat.

As Dunston pointed out in another thread, if a Black Horse agent were used, that would establish the link. If the garage agent was used, no link exists.
