POPLA Now Staying Appeals Pending Beavis SC Decision

Would you rather that they used the CoA result as a precedent??
There is a lot of merit in it. For example, it clearly says that PE are not offering THEIR contract but the Principals.
If your case is stayed, use the time to get the Principal to cancel and take the legs from under any PPC.
They may say "can't cancel" but that would be a lie. What it does is switches any liability from PPC v Driver to PPC v Client. And you wont keep your clients by harassing them - unless you are PE and don't give a sh*t
EDIT: Just been reminded that Civil Enforcement don't give one either as they are taking Co-op employees to court for parking on Co-op land. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

Parking Eye shot themselves in the foot by asking for all cases to be stayed before the court of appeal verdict. Now it's being appealed they can't complain that all cases are stayed again. They should have just carried on as normal, accepting the POPLA overturns before the verdict and they would be winning more POPLA cases after it.
Oh well, silly sods.Changing the world, one sarcastic comment at a time.0

I don't think the volume of stayed cases is any problem for PPCs, as only around 2% go to POPLA.
It is likely to be a problem however for POPLA.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I wonder if POPLA are as confused as we are by the CofA judgement and this is a cop out.REVENGE IS A DISH BETTER SERVED COLD0

Hi all, newbie here, I have followed all the advice and used the appeal template for PCN from parking eye. (15min overstay at Moorgate car park) my appeal was rejected by parking eye so I am now in the process of filing a POPLA, is there any point if it is going to be adjourned. I have been to the car park this evening to take photo's of the signs, which are all around 7ft high the only sign I found low enough for me to read the small print has the bottom right corner broken off so I could not read all the conditions and the £100 charge is now showing £1 quite funny really as that is much fairer charge for 15min. I will add the photo when I can figure out how to. any advice will be greatly appreciated0

I wouldn't think that POPLA will want hundreds of stayed cases stacking up until November of this year, or even well into 2016.
the people that do the appeals are out of it in September , when the new lot take over
I suspect London councils don't give a monkeys and are quietly having an easy few mths
lets see what happens in September?0

There's the real danger that if you don't file a POPLA appeal (even though that might end in a 'stay' subject to the Supreme Court decision), PE might press a court claim. A much more detailed and time consuming effort for you to deal with compared to a POPLA appeal.
And if you ignore the court papers - a default judgment against you. And unlike POPLA, this decision would be binding on you. Kerching for PE if you pay up; credit rating damage for you if you don't.Please note, we are not a legal advice forum. If you don't file a PoPLA appeal and you don't pay the chances are approximately 1:10 that PE will bring a court claim.
