Second hand mobile enquiry

Today I bought a second hand phone from one of these second hand trade In type shops.

I was given a receipt with three month guarantee.

As I was leaving the shop, the manager called me back. He then verbally told me, after sale, that should this phone be blocked, highly unlikely it may be, then I was not covered. I asked if this was then my tough luck, and he said "yeah".

Luckily the phone works, but I still felt conned. Had he of told me this before, I would not have paid £250 for a phone, but rather £150 more to buy it new.

Is this legal? Obviously the phone is fine right now, and hopefully this ain't gonna become an issue.

My worst was becoming mentally ill. The flying school wrote 3 yrs later asking me to come back as instructor, I had to decline on health.. Advice: live to the max each day

    No. When you buy goods from a trader, there is an implied term that the goods are of satisfactory quality and fit for their purpose.

    What the trader is doing (telling you you'd have no rights if it turned out to be stolen) is against the law and can actually amount to a criminal offence since it seeks to mislead consumers about their statutory rights.

    The trader needs to supply goods fit for purpose, he is responsible for that, He can't, no matter what he tells you get out of that. If the phone does turn out to be blocked then it is not fit for purpose, being second hand makes no difference. Only problem is it may take court action to get him to agree.


    One thing I have found out over the years is that shop staff don't know the law and when they tell you something they actually believe it.
