Refunds for items bought on a debit card

Bought a pair of fitflops from a none authorised site (it is almost identical to the real one), and paid 50gbp for item.
Informed by sellers that the items were not in stock and long delay or not likely to be supplied, and would we like to choose available more expensive items.
Stated no cancel order and refund money.
Seller States this will take 30 to 90 days and we will have to pay a 5% discount ( I think they mean charge), listed a claim with the bank, suspect the company is in the EU. Is this legal?

That depends where they are based and what law governs the contract.

If they were a UK based company with English Law governing it then no it wouldnt be legal however if they are in China or USA or somewhere else then potentially it is but you'd need to check the consumer protection law in those countries/ states

Look into Visa or Mastercard chargebacks - you may be able to get advice from them (depending on if your debit card is Visa or Mastercard).

Consider asking your card issuer for a chargeback.
