Removal of legal charge

I have recently obtained a mortgage with my partner on his existing house he had with his ex wife. However in order to start the mortgage his ex wife had to pay a debt in her sole name which had a legal charge secured on the property. His ex wife claims to have paid the debt to debt agency acting on the loan providers behalf and she has provided evidence of payment but it is now 13 weeks since it paid but the charge still remains. My conveyancing solicitor informs me that Land Registry have not been informed it has been paid by the original loan provider.
It seems I am stuck with an offer of a new remortgage but cannot progress due to the Legal Charge still remaining for a debt belonging to my ex wife. I have written to both the debt agency and the original loan provider but because I am not the client they refuse to communicate with me. What can I do ?:(

When you say she has provided evidence of payment - do you mean to yourselves? or to the court?
What does the restriction of the title actually state? I think they will often state something like 'no disposal of this property to be made without the written consent of 'X'. If it does have a clause like that then who is named?
As this is for a debt that will have gone through the courts she may need to get a certificate of satisfaction from the court to get the restriction removed. Maybe try calling national debtline to see if they could advise?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Janetd - as Tixy says, how is the loan protected on the register?
If you owned it jointly and the debt was just your ex's then it is unlikely to be protected as a legal charge“Official Company Representative
