HTC phone supposingly outside warranty

Hi all,

I am looking for some advise, I had an issue with my HTC smartphone where the vibration wasnt working and the screen had some faded lines in it and have sent it to HTC for repair.

The phone is within the two year warranty, there were no serious damage to the casing or the screen, however there were some scratchs from wear and tear on the casing. Unfortunately I did not to take any photos of the device before sending it to HTC directly.

HTC have come back to me stating that there is a visiable crack on the screen, which wasnt there when i sent it, therefore out of the warranty and wont do anything about it. I know its my silly fault for not taking any photos prior to sending it. But is there anything I can go back to them with or do I just pay for the phone to be fixed.

Any help would be vastly appreciated. Thank you.
