Rental Deposit Issue

Hello,

I recently moved out of my rented property and am having issues with the rental agency regarding the deposit (I feel they are being completely unreasonable)

I have obtained some advice from a friend who owns a letting agency and have said that by law I am allowed to go back into the property and fix any issues they have found (As long as it is within 2 weeks of when I moved out)

So I have proposed this offer and received the following response;


Thank you for your email.

Unfortunately, we are not allowed to release the keys back to you now that your tenancy has ended. We should receive a quote for this by the end of today.

Please forward on the discrepancies when you can and I will be sure to look over these for you.

Can anyone shed any light on where I stand/where i should go with this?

    Have you paid rent up until "2 weeks of when you moved out"? If so, yes it's still "your" home and you can enter. If you haven't then, no, you can't.

    In regards to the deposit issue. Was it protected? Was there a dual signed inventory from when you moved in to the property? And a check out report?

    Negotiate on any items you think are unreasonable.
    If you cannot reach an agreement then raise a dispute via the appropriate tenancy deposit scheme where your deposit is protected.

    If your tenancy has ended you have absolutely no entitlement to re-enter the property for any reason whatsoever. I'd ask this letting-agent friend of yours to quote the regulation which gives you this right. Hint: there isn't one.

    That's incorrect.

    OP has a right of access, and in fact he is the only one with a right of access, if the tenancy continues. This is not related to the status of rent payments.

    If the tenancy has ended then there is no right of access. This seems to be the case here.

    Another vote supporting the 'no right of access' lobby.

    Is your friend's letting agency a member of one of the required bodies as per the Enterprise and Regulatory Reform Act 2013 S83 ? Has he had any training? Is this the only gap in his knowledge or is he a complete dunderhead?
