Please can someone help me.


I am wanting to make a claim against a company and know the owners name.


do I put the claim form showing the company name or the owner trading as the company name.


I put the owners name, with just the company name underneath and it has been sent back.


Any help would be greatly appreciated

    I think the clue here is that they sent it back after you put he owners name down so send it back again with the Company name first and maybe attach! a post it note saying so an so Trading as to clarify that is not a Limited Company.

    Is it a Ltd co or not.


    If it is no and it is John Doe T/A fixitfast for instance then you just need to address it to John Doe because the trading name is irrelevant, as the owner is a sole trader.


    If it is a ltd co just address it to the name of the company because it is the company your taking to court not an individual.


    I suspect the reason it was sent back was nothing to do with the addressee just the person who refused it doesn't want it served.


    You can just send 2 copies from different post offices with proof of posting and this will be accepted by the courts. Alternatively in Scotland we can have Sheriffs officers deliver it for us for a fee, whether the recipient accepts it or not the officers leave it attached to the door and it is considered served. Maybe you have a similar set up with your bailiffs.
