Strange plot question....

I am buying number 15, this is a unregistered property in probate. There there is a discrepancy over the land the picture explains it all. How do I approach this? The land at the rear of 17 has no other access other than his property and mine (15) My house was built many years before the others. The land boundary are clear on the plans but is is hardly a good start to neighbor relations.
As the house has been empty for two years this might be something that has happened recently as the fence does not go the full way down the garden.
Thoughts please (we are not talking about a small bit of land here!)

Down to your solicitor to sort out with the vendors and/or the possible trespassers.
If they are unregistered there may be a historic sale of the partial plot which is unregistered.
If it has been like that for 12 years unchallenged then 17 may have gained adverse possession rights anyway.

You really need to discuss this with your solicitor. He's responsible for checking the title and making sure you get the land you're expecting (and professionally liable if he gets it wrong).
If he can't sort out the boundaries and access rights then perhaps he isn't the right solicitor for the job, or perhaps this property is not for you.A kind word lasts a minute, a skelped erse is sair for a day.0 -
Have you downloaded the documents showing no. 17's plot for comparison, in case it has been incorporated at some point?
I always find it interesting when there are these lines within plots as in the line map shown. They were obvs separate historically and yet sometimes the same person owns several parcels and it's hard to know who should own them.0 -
I suppose if it can be proved that he doesn't own it but you (one day) do then rather than be all nasty and demand huge sums for the purchase, you could settle on a rental agreement. Assuming you don't have plans for it yourself.0

2) are you using an online conveyancing outfit or a solicitor. If online - stop. Get a solicitor.
3) are you planing to rely on a bunch of amateurs on the internet? - stop. Get a solicitor.

* for how long?
* have any fences, hedges, boundaries etc been moved?
* how long ago?
* did the deceased ever use the plot?
* when?
Who are the Executers? Family? They may know answers.
Speak to number 13 - how long have they lived there? Did they know the deceased? Do they know the history?

This only come to light last Thursday so will give the online guys a chance they have been good so far.

A little update, EVERYBODY is confused by this, Solicitors, Vendors and estate agents. However as it is the only bit of land as well as the house I am buying it is though it belongs to my house (as the land originally belong to it.)0
