    How long can the house be kept 'in the estate ', unsold, without being distributed to the beneficiaries? .I know of the 'executors' year' but if you put it for sale for more than it's worth you could drag it on for years, during which time your friend would be able to claim his benefits.

    If the other 2 beneficiaries are also on benefits they may not be eager to sell .

    What is the value of the house? Bradford is ,..how shall I put this, not exactly Mayfair when it comes to house prices; it might only be worth £40,000. After selling costs and split 3 ways, pay a few debts off and your friend might only be left with £10,000.

    But it will cost them all money out of their benefits in the meantime. After a set period, there may be CT to pay. If the house is left without heating over the winter, it will deteriorate and lose value. Someone will have to do house and garden maintenance or pay for it to be done.

    So he thinks the taxpayer should continue to fund him despite the fact he has such a large asset? Benefits Britain at it's finest!

    Your friend needs to double check there isn't a will. If there is a will then he needs to know exactly what it says, does it say the house is to be sold and split between by 3 children or does it say I'm leaving the house to my 3 children? If there is no will then they will own a share of a house.
    Clearly the most sensible and logical thing to do would be for all parties to agree, the house to remain in the name of 'the executors of mrs x' until it is sold , any expenses paid out and the estate split 3 ways.
    Fairly or unfairly the state will say he has an asset and that he therefore should not get benefits.
    It might be worth a word with the solicitor to find out how much is hourly fees are and then point out to the other 2 that if he has to start proceedings to force a sale then it will cost x amount per hour which will eat into any money they will eventually get.
    Is it possible for all the siblings to talk about the house? Perhaps they could meet at the solicitors to discuss the options?

    Edit: I can understand him thinking the house may be worth a lot in the future (not that I necessarily agree with it) but frankly a house that may or may not be worth a fortune in the future, which requires upkeep and is jointly owned with his family is likely to mean not being able to afford a roof over his head or to be able to feed himself right now. It clearly just isn't a viable option (unless the siblings want to rent it out to earn enough for all 3 of them or they pay your friends living expenses for him).

    It may be possible that benefits would not be affected as it could be argued that their capital/share of the house is, in fact, nil because because of the refusal of the other two to sell.

    This is complicated and it is late! Will post some guidance about it in the morning.

    Having said that it does seem sensible for the house to be sold.
