Small Claim Advice

Again, how can you be so sure of her financial status?
If she's playing you as you suggest then why are you so bothered about baliffs going round?0 -
daytona0 wow, that's quite a bizarre attitude you have there and quite a confrontational reply. You could have just asked me to clarify a couple of points.
No, I don't want to destroy their life. I just want the money that's owed me, and they're making it as hard as possible to get it. They're working illegally while claiming ESA and housing, can quite easily afford to pay me in full, but keep lying to the court.
Hence me asking if there's anything I can do about that, and anything I can do to speed the process up a bit. The court seems blind to the lies, despite them being ridiculously easy to verify.
pinkshoes I'm not sure they do, besides a laptop, but I'm told bailiffs can't seize that sort of thing if it's claimed it's for a business, even if that business isn't actually real?
The beauty of having a confrontational attitude is that people will feel obliged to defend their position and so the intricacies of the case will be revealed.
The main thing I took out of your reply was "I just want the money that's owed me, and they're making it as hard as possible to get it."
I reply with 2 questions:
Would that proposed 100 pound a week have resulted in your getting the money which was owed to you?
Have you given them a chance to refuse to pay the 100 pound a week? (ie missing a payment)
Forgive a third party who, on the face of it (you may have clarified the point further in subsequent posts but I haven't looked), only see you refuse to accept a somewhat generous 100 pound a month payment to clear the balance. One must question the motivation for that. If you are genuinely just trying to get the money faster then I wish you luck.0 -
To what end? The intricacies of the case (or the history between myself and the defendant) have absolutely no relevance to the original question, nor are they anyone's business. I've answered a few questions merely to give a little more information and get more relevant answers, but I see no reason to go into detail, not least for the fact that it would be boring and redundant. The beauty of having a confrontational attitude is that people will feel obliged to defend their position and so the intricacies of the case will be revealed.0 -

"nor are they anyone's business" - if you post on a public internet forum then you are fair game and you make it other people's business.
They most certainly DO have relevance to your original query. One must establish the motivation behind your actions, and to what extent you may be acting reasonably/unreasonably. This facilitates further advice, as if you aren't acting out of spite (as per my original conjecture) then you'll make a coherent argument and disprove that.0 -
Posting publicly doesn't make my business other people's business. I posted enough information for people to be able to give a little advice. Anything else is private and entirely my choice as to whether I share it or not."nor are they anyone's business" - if you post on a public internet forum then you are fair game and you make it other people's business.
The motivation is irrelevant to the question. I'm asking for legal advice and general help, not a moral judgement on why I want the money that's owed me.They most certainly DO have relevance to your original query. Errm ok. Welcome to a public internet forum! The motivation is irrelevant to the question. I'm asking for legal advice and general help, not a moral judgement on why I want the money that's owed me.
It isn't irrelevant. If, for example, you are on a personal vendetta (note the use of the word IF) then the legal advice and general help may be different.0 -
I found out that I had been 'scammed' for £3000 when I applied for a CCJ against a roofing company. I can't help you, but possibly make you feel better by you knowing that you're not alone in your thoughts. It's taken a long time and the CAB and Court staff were not helpful at all. The Police are now involved in the case finally after a long time of worry.0

Not at all. The advice would be the same regardless of my supposed or perceived motive. The only reason for asking for more information is to give more specific advice, like a few helpful people have done.It isn't irrelevant. That's the last I'm saying on the subject.0 -

True! But you made the thread, and you willingly abandoned your right for privacy in relation to your court dealings with this chap.
In contrast, I haven't abandoned my privacy with this post because (aside from personality traits) you have learned nothing about me.Not at all.
