council tax overpayment

Hi, wonder if anyone can advise me. i was single in my home until july last year, until then i got the 25% discount, i wrote and told them my partner was moving in on a particular date. my council tax remained at around the same amount but i just thought it had been recalculated over 12 months instead of 10! when i went on my account online in april i noticed that the 25% discount was still on, i rang them and they confirmed they had received the letter but someone had forgotten to take if off! so they have spread the overpayment over this 12 month period which has upped my payment by approx. £25 per month. do i have to pay this money back if it wasn't my fault?

Regardless of how the monies are caused they are still re-payable.You could ask the council if they would write it off as a gesture of goodwill but that would be purely at their discretion (unlikely to happen).I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0

when I saw the thread title I thought you were talking about having paid too much council tax. I know in that case they actually take off over payments off the next year's bill.
This is in fact is about under payment of council tax. Fortunately for you, it is not your fault the council tax was paid incorrectly as you notified the council of your partner moving in. I suspect this is why they are saying you can spread the payment for the months that they failed to change the direct debit. You are still however liable to pay the correct council tax.Paid off the last of my unsecured debts in 2016. Then saved up and bought a property. Current aim is to pay off my mortgage as early as possible. Currently over paying every month. Mortgage due to be paid off in 2036 hoping to get it paid off much earlier. Set up my own bespoke spreadsheet to manage my money.0 -

Regardless of fault, any council tax for this year would be spread over the statutory instalment period (as a minimum).
