Parking ticket when pulling over to vomit. Advice please?

    The circumstances almost exactly mirror those that applied in the case of Vine -v- London Borough of Waltham Forest [2000] EWCA Civ 106. (link to judgment) It happens to be that this case is a PPC favourite - which they always brazenly misquote.

    On this occasion it could be used in context and appropriately. Mrs Vine was suddenly taken ill at the wheel and pulled over to be sick. During the short period she was out of the car it was [thoughfully] clamped by the local authority. The Court of Appeal decided that she had not seen the signs and consequently could not have taken in what they said. Appeal upheld LB Waltham Forest ordered to refund the clamping fees.
