I am unsure how to proceed. The driver put £2 into a pay and display machine to cover 2 hours parking, but 10p was rejected and the machine only printed a ticket for £1.90. Technically, this should have covered the driver for 1 hour 54 minutes, although the ticket stated a return time of 1 hour (but also displayed a sum of £1.90 paid and the time of payment). The driver then spent money in a nearby cafe, who refunded the £1.90 (they refund up to 2 hours). The driver returned to their car 1 hour 25 minutes later, but had been booked 5 minutes earlier. The parking attendant was present and said that nothing could be done and that the driver should have put a further 10p in after the ticket was printed. The driver has spoken to the cafe to try and get them to cancel the ticket (all receipts provided) with no luck, as it is unclear who the landowner is.
The car park is privately owned.
Assuming that the NTK will arrive, when it comes to the first appeal stage, would you include any of the above (which proves that enough money was paid to cover the time parked, but also more or less suggests that you know who the driver is), or just use the standard template and go down the POPLA route?

There are t&c that you transgressed and the PPC will stick to that. You didn't pay for 2 hours (fact) and parking is in hourly slots.
You can try it, but I don't think you will win (unless the PPC has been watching the BBC tonight and tomorrow and has had a road to Damascus conversion ! )
Just make sure you get your POPLA appeal ready too.
You might give us a heads up as to who the PPC is so that you can get an opinion as to whether they do court or not.0
