PCM Ltd have ignored my initial letter - PLEASE HELP

Would really appreciate some help with this one!

Basically, my car was parked in my gated car park (I am a resident) and while I was on holiday the parking company in charge changed. (from UK Parking Solutions (BPA) to Parking Control Management Ltd (IPC).

When I got home I had a nice yellow sticker on my car, and a new permit to be displayed in the post. I appealed to the company stating reasons I was not liable to pay (not genuine pre-estimate of loss, no contract formed etc all the usual stuff).

However, they seem to have completely ignored it and shortly after receiving a Notice To Keeper I have just received another 'Keeper Libility' letter stating that I have 14 days to pay, it's too late to name the driver/make representations. Also says the usual threat of 'If payment isn't made we will pass your details to debt recovery and could include costs, County Court etc etc.

I'd really appreciate some advice about what to do next, I've drafted a letter that explains they ignored my initial correspondance (which I was going to include in the envelope again).

    Rent it, but can prove residency with tenancy agreement/letter from landlord.

    Whats the tenancy say about parking ?
    Does it mention permits ?

    If it does not you may have a contractual right to use the space unhindered by secondary contracts.
    I do Contracts, all day every day.
  • Your car, your space - you pay rent for both. This one won't go anywhere near a court. Check what you tenancy/lease agreement says about parking, and whether or not you need to display a permit. If the first PPC didn't require one, then why should the second one?

    No mention of permits, only thing I can find is:

    "The tenant will not:
    park any vehicle on any approaches, private roads or other cummunal areas belonging to the Building except in parking areas (if any) designated for use by the occupants of the property."

    Captain Leaky - Thanks for the reply, the first PPC did require a permit and it was displayed at the time - but because the new one had come into force while I was abroad they gave me a ticket.

    What do you suggest I do? Ignore or reply saying why I'm not liable (again)?
