Despite being promided a call back today with details no one rang me, I didnt chase it up as parents are visiting my old place.

Will contact them tomorrow, but I will also mention they write on their website they dont charge fees such as for credit check but they only tell you when you put deposit down you have to pay with reasoning being its a third party that charges therefore its not them.

Really messed about now, rang up to get a disintered response saying member of staff never told the main member what was happening, and said I either need a guarantor or pay 6 months,

When I mentioned what I said before I was told she didnt know, and when I asked about just getting my money back she told me to "wait another day and think about it" and seemed to avoid the question on returning the money just telling me to wait till tomorrow.

She confirmed they dont count benefits as income!

Whether you go for the property or not, you are legally entitled to your money back. One of the big agencies used the fact their head office was in England to basically blackmail me into paying (we won't do your reference if you don't pay up) but I'd be inclined to go elsewhere; if they're this bad before you're a tenant, how bad are they likely to be after you've signed the contract?

I don't understand why you paid for a credit check when you already knew that LAs are not allowed to charge fees in Scotland. I doubt if you'll ever see that money again unless you're prepared to take them to court, if they're happy to flout the law I'm sure they will have no problem at all ignoring anything you ask for.

Sorry didnt notice your post before, my reasoning was that I knew down the line like end of contract I could claim it back, plus I knew if I outright refused to pay it I would be rejected anyway so Id rather get a good property and then claim back as its the only LL I saw with properties in good locations, others are miles away in rough areas in the area mostly for same prices.
