If you don't complain, it's not a dispute. If you have a dispute, then you would have to declare it when selling. So if I were you I would just leave it.
Strictly-speaking the neighbour has taken the P, but given it's at the back of the garden and a tiny overhang, and most importantly not draining onto your side, then it's one of those things that might not be worth bothering about. It could put off a buyer, but that's more likely because it's ugly and overbearing than it is a hot boundary dispute.

Is that garage at the bottom yours? Does its gutter, perchance, overhang next door on the left? .......0

As a buyer I would be more worried about what it was being used for/ Maybe a DIY mechanic or joiner etc using it as a weekend workshop would be a big turn off for me.0
