RS2000 - this is what I'm dealing with. I think he means do no work/construction within a metre of his house but I'm past trying to understand the rantings of a madman!

I really just want to know what I can do if he comes out of his house this weekend with a hammer and knocks down my gate!

Or, if he wants to be civil and have the post detached from his house, what the procedure is

If he wants it detached from his house I'd be inclined to do so for the sake of a peaceful life. It'll probably mean removing part of the path, setting in a post and relaying.

Can he remove it from his wall? Probably.
Can he come onto your land to do so? Again probably.
Can he smash down you gate with a hammer? Well that's a matter for him whether he wants do be done for criminal damage.

So is it attached then, or just adjacent to his wall?

Either way, he should absolutely not touch it but you could offer to ensure it is 'unattached' and fixed firmly in concrete in the same position, ie about 1mm from his wall.

It is attached, yes but how I do not know

We have sold so I really want to avoid any conflict whilst things are progressing.

I like the idea of offering to do it, if only as a stalling measure until we are gone. But again, this assumes we are dealing with a sane, sensible human being.

At a guess frame fixing or plugs and screws. It'll be something cheap if the builders did it.

Tell him you'll do it but you'll need a new post as it'll need to go in the ground a couple of feet. Wickes maybe out of stock or only have warped ones when you go. ;)

There is no limit to the amount of pettiness of some people in modern life.
I can afford anything that I want.
Just so long as I don't want much.

Unbelievable. Makes you feel sorry for the poor sod who's going to buy your house. Its your worst nightmare when moving that you end up next to someone like that.

He has probably spotted the opportunity to do this before the new people move in, we have a neighbour on one side who can't have a conversation he just rants and swears if he feels he has an issue, even at his wife sometimes ( they are both late 70's) and she is just as bad. Fortunately we are detached and we don't have to have anything to do with them ..

If there are fixings into the wall then the neighbour may be entitled to remove them.

You would then be entitled to dig down beside their wall to concrete in your post.

I would share this information with him if he mentions it again.

If he removes the post himself, get a new one installed in the way described.
