My husband has been scammed by Red Reclaims who promised to refund the PPI search fee if no collectable PPI was found. Red reclaims are no longer in business and have not found PPI nor refunded the fee. Following advice from this website we contacted the credit card company (in this case Barclaycard) to claim a refund under section 75. Barclaycard tell us that nowhere in the paperwork for Red Reclaims does it say that money will be refunded, therefore it is a straight search fee, (therefore no scam has occurred and Barclaycard will not refund). That's certainly not what RR told my husband (or anyone else, who all seem to have managed to successfully claim from their CC company.) What is our next move, please?

Either find proofs good enough for presenting to a court as evidence or give up.0

How do you know other people have managed a successful S75 claim against them for this fee? If you have proof of these successful claims then it could help your case, the more people that say they were successful the more likely the financial ombudsman would rule in your favour.
Without any proof however the only thing that really matters is the written contract, and that doesn't mention it.0 -
I know others have been successful by reading the forum on this website on 'how to claim back your credit card charge if you have been scammed by Red Reclaims'. We followed the advice given, sent the contract but Barclaycard says no.0

Your only other option would be to put a complaint into the Finanical Service Ombisman and they would decide.0

As you did send your copy of the contract to Barclaycard, you must have seen whether or not the refund was mentioned in the document. If it was not there, and the refund in question was only something your husband was told (or believes he was told) during a telephone conversation, then you have no evidence.
You could have asked for conformation in writing if it was not mentioned in the contract.0
