The advice doesn't need to change except in terms of how to win at POPLA which must involve rebutting the evidence pack, which PE are posting a week after they email it to POPLA. The first appeal is still valid and the drop hands offer is deliberately included.

    So to be clear.

I send my appeal to POPLA as per the standard templates.
Then when I receive PE's pack I then submit again to POPLA with a rebuttal of PE's pack? Is there a template for that?

There are no 'standard templates' for a POPLA appeal. There are numerous examples of what has worked successfully in the past, but it's not a question of just copying and pasting, send it off and expect to win.

You need to get a good grasp of the points you want to make and what it is you're going to say against each appeal point.

Read the sticky right at the top of this forum's index 'POPLA Decisions' (read it from the most recent backwards, not from the first post), and here is a link to 'How to win at POPLA', but do note that all the example appeals were written prior to the Beavis CoA case and will possibly need adaptation in the context of GPEOL.

In terms of rebuttal of evidence pack - no template, but there are examples of robust rebuttals. But one step at a time, read up on POPLA appeals and draft your own appeal, the take it from there.

Don't miss the POPLA deadline or your case could well be heading for the Small Claims Court.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
