car tax fine advice

I was hoping someone could offer some advise on the new car tax changes, we brought a new car from a dealer in November it was advertised as having car tax included on the website. However due to my own ignorance did not realise that actually the car tax was down to us and it was actually advertised incorrectly.
Hence we did not buy car tax got clamped, had to pay to have the clamp removed and the a fine for having no car tax. Yes I admit my stupid fault, but we did not receive any warning letters from dvla, are they allowed to literally just clamp you without warning, we had only had the car 2 weeks!
I tried writing to them to appeal it and they told me to get lost, contacted the car dealership and they have taken all the previous adverts down from their website saying it came with car tax and basically to get lost.
Is there any recourse for us to get our £230 back, it seems that without warning from the dvla they are basically stealing from people.
