Can i claim charges and PPI when taken to County Court?

Hi there my credit card company "Capital One" have taken me to County Court and i have received the response notice. The total is over £1,600 and includes bank charges and interest.
1. Is there any way to get off this? It is a few years old?
2. Can i counter claim or defend for bank charges?
3. How do i find out if i paid PPI and can i defend or counter claim for them?
What is the best thing to do?

1) No - unless it is more than 6 years since you last acknowledged the debt (paid something or confirmed you owed it) then they are within their rights. If you pay the total within a period (might be 2 weeks or a month) of the CCJ being issued you can avoid it going on your file
2) No - banks won the "unfair charges" court case, you would struggle to overturn the supreme court judgement and even then, unless the £1600 was all charges your case would simply be that you owed them a bit less
3) PPI is listed on every statement as a separate line when you carry a balance - simply look on your statements or ring the CC company and ask them. If you had it AND you did a miss-selling complaint AND they agreed, they can write off the PPI refund against your unpaid debt - you would then either owe less or get the balanceSam Vimes' Boots Theory of Socioeconomic Unfairness:
