Hi i am posting this on behalf of my brother, he works for sainsburys part time fridays and saturdays, well a week ago he fainted at work and they sent him home however i now find out he's had a warning/disiplinary for this, surely they cant discipline for being genuiely ill, he even had the doctor out who said he had low iron levels or something similar hence the fainting.
Where does he stand on this as he was sent home by them then surely he cant recieve a warning for it?

Is he in a union? If so contact his union rep for advice.0

It seems outrageous! Was the warning he received at the time of the fainting...did they think he was drunk?? What were their reasons for the warning? How did they word their warning? It could be that they have told him not to come to work if he feels ill and he has taken that as a warning. No employer should treat an employee like this for genuine illness. I have some experience of employees of Sainsburys and have never heard of anything like this before. I am assuming your brother is young and therefore will probably not want to stand up to his boss and ask for an explanation.Perhaps someone could ask on his behalf??I have had brain surgery - sorry if I am a little confused sometimes0

Thats well out of order!!!
My daughter works in Morrisons, she got pulled in by the management the other day to give her a warning - because she had had three days off ill in 6 months. :mad:This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
I worked on a long term contract for a temp agency who were very strict about illness. You were allowed 2 short sickness absences in a year. On return from your 3rd illness, you would get a verbal warning, then so on till you were sacked. Even if you were genuinely ill, and had a doctors note, you were disciplined.
Conseqently people came to work when they were ill, and I managed to catch loads of colds and tummy bugs while I was there :mad:Here I go again on my own....0 -
Has your brother been off sick much in the past 12 months? I know that Sainsbury's Supply Chain employees (those that work in the distribution warehouses, not in stores) are allowed 7 sickness periods before any kind of disciplinary/warning process starts. It used to be 13 in any 12 month period, but they have now cut it down to 7. In the interests of fairness & equality then unless this was his 7th sickness in 12 months he should not have received a warning for it.
He may have had to have a return to work interview to check that he was fit to work & possibly a drugs/alcohol test (standard practice), but not a disciplinary if this was his first incidence of sickness.0 -
Much depends on how long your brother has been employed by Sainsbury's. If less than 12 months then they can dismiss him for almost any reason provided that it is not sex, disability or race discrimination etc.0

I work for Morrisons and their policy is very stict but I accept that because we have a large store to run. I haven't had any sickness in 4 years mainly because I would feel too guilty and also I don't want all the hassle.0

Warehouse where I work has a disciplinary system tied to the sick scheme so I could take 6 months off sick, get paid for it and not get a DP. If I then took off another odd day I wouldn't get paid and would get a DP. Its also possible to get a DP if you have an accident and its not your fault.
On the subject of accidents, if you have an accident and its not your fault you would get breathalized and drugs tested and if you're over you are sacked as the accident is now deemed to be your fault. Some of you might think that is ok but because this follows european legislation you can actually be legal to drive yet over the work limit.
Last point. You can get a final written warning in up to nine categories or finals in all 9 because they aren't tied together.
Funny old would, ain't it.

my girlfriends mum works at asda, and if anyone has a day off sick they get disciplined for it.
in my opinion it is appalling, especially since they are paid only 5p over minimum wage.
nobody can go to a union, as soon as they do they will find ways to sack the people who are causing problems. it's no skin off their nose as getting more staff is simple.
it is so unfair that it doesn't even pay to be loyal in some jobs these days.'What's poignancy grandad?'
