argos dishwasher after 12 months

had 2 faults happen soon after 12 months of purchase. 1 was a washer disintegrated at 13 months causing arm not to spin and 1 today that is dishes not drying, total cost to fix and with call out plus parts and VAT etc is over £200 and the dishwasher was not much more than that to buy!!
what are my rights?
issue 1 was already fixed at 13 month mark, I have the repairs invoice and the repairer had never seen a wahser disintegrate like that or so quickly, there was just the rim left.
issue 2 just happened and not fixed yet - I would not expect a heating element to go wrong after just 20 months

argos told me that because the 1st repair was not done with them (argos) but independantly, they will not fix 2nd repair, as 1st repair voids the warrantly, as they are responsible for up to 6 years otherwise - is this correct?0

What makes you think they are responsible for up to 6 years?
Up to 6 months it is up to them to prove the fault is not inherent, after 6 months it is up to you. a guarantee/warranty is in additional to these statutory rights
At 13 months you had someone else repair your machine. That has voided the warranty terms, so you can no longer claim anything back under that. You could try to get an independent report stating that your current fault was inherent to the machine when you bought it, but 20 months after you bought it, a heating element is unlikely to work fine for 20 months if inherently faulty.0 -
according to a 'which' guide online, a dishwasher should last 5-10 years. I would say 5 years was reasonable before a fault occured, this has been my experience in the past. A heating element should not go at 20 months.
The 1st repair was certainly inherent fault, the engineer had never seen this before, and said it should not dissolve a washer like that.
argos said it was 6 years. They also said the 1st repair voided the 2nd repair, even thought the 2nd repair is completely different. I want to know what piece of legislation states this.0 -
6 years is the MAXIMUM time in which you can bring proceedings. It does NOT imply that all goods will last that length of time or that you will get an automatic remedy or that you are relieved of any burden of proof.0

Warranties are not governed by legislation. They are up to the person providing it.
You are trying to claim under your statutory right under the SOGA. For that you need an independent report stating your fault is inherent.

I did not claim on first repair, as needed it fixed quickly, I agree should have claimed. I did contact them initially, but did not hear back.
Only after 2nd fault, I am realising what a piece of rubbish I bought and not good enough standard. Not sure if even worth repairing if such poor standard. The 2 bills together plus having someone fit it adds up to more than I paid for the appliance!!!0 -

It doesnt matter that you have proof of the repair. Why didnt you go through the warranty to get it fixed? Argos doesn't know how good your repairman was, nor are they going to go to any length to check his credentials. He could be the worst repairman in the world and damaged your machine.
They do not HAVE to repair it under warranty. If YOU can get a report stating the fault is inherent, was there from the very start (which with a repair under its belt and 20 months down the line will be difficult) they HAVE to repair/refund/replace it under SOGA.
But thats unlikely due to the length of time and the non warranty repair.0 -
