That's rubbish. Because my friend had a 12 week sick/fit note for JSA the advisor forced her to claim ESA which she was not entitled to as she was only going to be sick for 12 weeks.
This got her in rent arrears. Only to be told to claim JSA again

    How long ago was this?

The new legislation came into force in March 2015.

Why couldn't she claim esa for 12 weeks.? Perfectly acceptable and shouldn't have got her into rent areas either. Would just have meant notifying hb of change of benefit, so it would have carried on.

It takes longer than 12 weeks to get an ATOS assessment for ESA payments. so before that happened she was fit for work again with JSA suspended and no income. I was feeding her

You still get paid whilst your waiting reckon she was telling you porkies, ive been paid since the 1st april, not had my assessment yet.
Hb was suspended till esa was awarded. Took 7 days for 1st esa payment and 10 days for hb.

That wouldn't have stopped her claiming ESA assessment rate.

Something doesn't sound right unless you are talking about the waiting time to reclaim JSA.

Its only suspended, minute the letter shows on their system they unsuspend it. you dont actually loose any money because of it.
