DIY Divorce - Sample Consent Order

My friend is going through a divorce after a 5 year childless marriage.

They decided to save on solicitors' fees and went for a DIY divorce.

The trickiest part as it seems is applying for a consent order. I helped him find http://www.wikivorce.com/divorce/Financial-Settlements/Financial-Settlements/Consent-Order-Simple-Example.html as a reasonable draft consent order sample, but I wonder if anyone have a better consent order for a clean break, maybe from a personal experience?

  • Even if your mate is doing the divorce himself/herself, they will still need to get a consent order drawn up by a solicitor. The language used in consent orders is very technical, and the order is a legally binding and court-enforceable order so it's vital that the order is written up by someone who knows what they are doing (ie a solicitor). If you follow the link the you provided, I saw that that company offer a simple "clean-break" co for about £160.

Yeah, it really sounds like paying £160 just to get a Word template document which someone else might already have.
  • Perhaps your friend is better trying to find their own information about consent orders - there is nothing worse than a cynical "friend" .

Each Consent Order needs to be drafted up individually for each client to reflect the parties' individual agreement and assets/debts. What has been written for one divorcing couple will not be suitable for another. Best leave this to those who know what they are doing.
