By composed I take it you mean you write it and get him to sign it?
You can't purport to be him as that could amount to fraud.
Technically, the company shouldn't even be talking to you about your fathers order unless he has given consent to them to do so.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Have you escalated your complaint officially? Have you done so in writing? If you have raised your complaint in writing and followed the companies complaints procedure and it has had sufficient time to resolve the complaint and you're still unsatisfied, an Ombudsman may be able to help.
google "Ombudsman Services" go to their site and click on the retail section, that may be a solution0 -
I have not had chance to get anything done as he sadly passed away this morning.
Things will have to wait...my wife needs support more than anything else right now.
Thank you to everyone, I'll let you know of progress when we get sorted.
Thanks again.

Hello
I have contacted CAB today and informed them of my father in laws death.
The template they provided me with was written in first person and could not be edited so I needed advice.
Unfortunately, it was not great hearing.
Apparently now, as he has died and is no longer able to 'represent' himself, as the contract was between him and the other party.
Due to (i think they said )"privacy" between both parties, the contract is no longer binding.
Basically they seem to have dragged it out with the intention of this happening.
Have phoned a few papers about it, The Sun said it was not shocking enough for them to run a story.
The Daily Express, who ran the story in the link posted earlier in the thread, are supposed to be calling me back, as they believe another complaint was made to them recently about the same company.
It genuinely is not about the money, it is about the principle. And incidentally, CAB said I may be able to get legal support as the company should have refunded after the initial phone call.
Thank You for the help, shame we live in such a miserable world.0 -
I have contacted a solicitor today and asked a few questions over the phone..
They have said that to take the case on...by a junior solicitor..I would need to budget for the first 3 hours at a cost of £118 p/h
I really don't have that kind of money and the supposed refund of the bed would have helped toward funeral costs, so I don't really want any further outlay.
My question now is ;
Am I screwed all ends up and have no point in pursuing this?
I am now sad rather than angry0 -

You can still log a complaint about the company and bring it Ombudsman Services, they may be able to help.

You don't need a solicitor for this - if you did use a solicitor you'd end up claiming for nothing or possibly having to pay money out as usually, legal costs are not awarded in small claims even if you win.

Some good news and some faith in humanity restored.
I took to , of all things Twitter to express my feelings about the company.
Now, be it coincidence or not, but a mere 37 minutes after my initial tweet and moan about the company, they responded via the same portal.
They then proceeded to tell me they had been trying to contact me to resolve the issue. I received a phone call the next morning (yesterday) and the lady told me My father in law would be getting a full refund as it had been escalated to the Managing Directors attention.
They are, to quote, only human, and apologised profusely, hoping that my faith and trust in the company was now restored.
Thank you to everyone for such sound advice and support.0 -
