Hi - I researched previous threads following a PCN from G24 for parking at Staples and sent off a very detailed challenge to PCN as advised (basically copied the full example given). I have received a detailed response basically telling me their parking charges are fully enforceable then quotes a case of Robophone Facilities vs Blank, the onus of proving that an amount is a penalty rather than liquidated damages is upon me (as the party against whom the parking charge is claimed). It goes on to tell me I can appeal to the IAS, then confirms they have been audited by an independent assessor on behalf of the Independent Parking Committee then tells me what POFA describes as `parking charge'. In effect it gives me 4 options a) pay the outstanding charge b)appeal to the IAS c)if I do nothing they will recover money through their debt recovery procedure and may proceed with court action and e)if I give them copies of receipts for the store - they may re-evaluate my case! Any advice please - do I respond or ignore?
