HELP - Notice of Intended Prosecution
How can i tell if is in fact a NIP?
It's a form asking for the name of the driver as my sons car was involved in an 'Incident'.
My son has a black box fitted to his car for insurance reasons and awoke one morning to a voice mail informing him that his black box had triggered an event during the night.
He rushed outside to find a couple of small dents, red paint (his car is grey) and one headlight hanging out.
He called his insurance company who confirmed that the car was outside the address all night and been stationary.
He looked for street CCTV but there were none, he even went into a NHS clinic but they had no CCTV either.
He's insurance company advised that he didn't have to do any more as no one was injured and no one saw anything.
Fast forward 3 weeks later, a form from the police arrives saying that his car was involved in and 'incident' 3 miles away.
The car failed to stop after an accident and driving without due care.
He called his insurance who are now saying that the car was in fact at the incident location.
He was fast asleep at a friends family home, his iPhone location data shows he never moved from the house all night.
There were 4 other adults in the house, who all deny taking the car.
If he takes the blame for this then he will lose his license as he has only been driving for 5 months.
He is totally prepared to go through the insurance as his black box puts the car at the scene but he is adamant he wasn't driving.

If the Black Box says the car was at the scene, then the car was at the scene- assuming it wasn't removed and refitted to another car or hacked or something.
He could of gone out without his I-Phone, so thats not really proof he wasn't driving. Where did he leave the keys, in his pocket, hanging up in the kitchen, left in the ignition?
If he wasn't driving then he needs to confirm who was driving. If the rest of the "adults" denys they took it then the probability that your Son drove his own car out and back again is likely if 4 other people say they didnt do it. If he didnt go out then he will more than likely found guilty and he needs to choose some better friends.

I understand completely the seriousness of this matter, and i have to stand by him if he says he wasn't driving.
He is going to reply giving the names and addresses of everyone in the house.Smile and be happy, things can usually get worse!0 -
Police will have to be involved, statements taken from the other "friends".

Can you get the GPS data from the insurance company? Might help you work out where the car went and who the likely culprit is
Where the car was parked overnight, was it in a position where it could be damaged by a passing vehicle, or was it obvious someone had Taken Without Consent when he inspected the damage?Changing the world, one sarcastic comment at a time.0 -

I wasn't judging anyone, just stating what will happen if no one admits to taking the car.

If what you have said here is what your son has said then I would be very suspicious of what he is saying (he probably knows who was driving but doesn't want to drop them in it. Peer pressure ?). Who gets up in the morning, finds their car bashed, calls the insurance and doesn't contact the police when they have know knowledge of what happened ?.
What you will have is a NIP and a S172 request for the drivers details. Failing to provide the drivers details will result in prosecution for failure to furnish which is normally 6 points, a hefty fine, court costs and massive insurance bills for several years. As your son has only had his license a few months then 6 points will see it revoked and he will have to apply for a provisional and resit his test again so it is very much in his interests to find out who was driving (I suspect he already knows).
You might be better to try Peepipoo with this as they tend to be better with this sort of thing than this forum is, but they can be very blunt0 -

Depending on which telematics insurer he is with - some of them display the journey details in an on-line portal so checking the date/time should show the route. Not all do this but they will definitely have the data. If the police are aware of the black box and the insurer then they may well request the data themselves as evidence. If this happens, most insurers will only release the data with a court order but if the request is made as part of a criminal investigation then they will probably provide it.
