Hi anyone able to help or give advice I need to send my defence for a small claims tracks by next week....really don't have a clue what I'm doing!!
Brief story I am a student nurse at Staffs Uni in March last year I parked at the Blackheath Lane site School of Health for a quick meeting I received a notification from DE that I caused an obstruction which I did not I may have been slightly over the line but was in line with the edge of the building and a bus could have got past!!! Initially I ignored it as the notice from DE stated I was parked at Beconside which is over a mile away I did eventually send an email stating this their reply was it was an address for the Uni - I still think this is strange.....anyway I ignored all over letters being wrongly assured it would go away....it didn't I got a solicitors letter over the Christmas hols sent a reply which they ignored and went ahead with the court. Submitted my defence said I would take part liability and offered 100.00 which they refused and have progressed to the small claims track. As I said I am a student nurse get no bursary and my parents support me....they are not best pleased and are considering just offering to pay believe it to be in the region of £205. Any help gratefully appreciated.

What exactly have you received ?
Stamped Court papers from the county court or a letter saying they will take you to court.I do Contracts, all day every day.0 -
Its the Notice of Allocation to the small Claims Track (Hearing) gives the date of the hearing and date my defence needs to be in by!!0
-
So you have already selected to defend the case.
What paper work do you still have from the parking firm and which letters mention the wrong site ?
Are they citing POFA 2012 keeper liability.I do Contracts, all day every day.0 -

Most important - do the papers state the correct or incorrect address? If incorrect, then you simply have to have a defence stating that you deny the claim and that you were not parked where the court papers state.
You then attend with the correct facts. They can not charge you with an incorrect address of contravention. You were, of course, naive to tell them that they had made a mistake in the first place.0 -
She needs to get the early paper work out, the ticket if she has it, the NTK and the court papers and STAY ONLINE and answer the questions quickly.
This sounds winnable with a good defence, so we might be able to make them throw it in.I do Contracts, all day every day.0 -
Where am I likely to find that info...I have looked at the Notice of Impending Court action and Letter before claim and can't see anything on either of them.0

Have you got court papers that look like this with a court stamp on them.
But with your details.
