Building Regulation Consent - house built in 2007

Hi,

We are (hopefully) close to exchange on a property we are buying (first time buyers) and the last outstanding issue seems to be that the seller's solicitor hasn't sent our solicitor a copy of the Building Regulation Consent. Our solicitor says the Local Search states that the consent has been given, we just don't have a copy. The house was built in 2007 and certainly does not look to have had any structural alterations/extensions since then - it looks the same as other new builds in the area.

My question is whether this is something we definitely should not exchange without? If the solicitors are unable to produce a copy, is it possible to get another copy (from the council?) ourselves and how long is this likely to take?

    Anyone can get a copy from the council. The sellers ought to (to save you whatever the fee is), but if I were in a hurry then I'd take a view on it (your solicitor might not, wearing their lender's solicitor hat). How long it takes depends on how understaffed the council's admin team are.

    Thats probably all you will get then. Normally on a new build NHBC sign off the Building Regs Compliance and inform the Council. There would not usually be a separate certificate from the Council.
