Faulty ipod

Hi all,
Apologises if this has already been discussed, but i've searched the forums and couldn't find anything.
I bought a 4th gen ipod nearly 4 years ago.
Recently i've been experiencing ongoing problems with it, whivh i believe followed a software update (i keep it on airplane mode to save battery, so it only connects to the internet through itunes, when i connect to my computer).
i've tried everything, as have the genius bar, and the only thing they can offer is a like for like replacement for £70 or 10% off a brand new one.
I feel cheated.
it's only 4 years old, and wasn't cheap in the first place!
Apple have also decided that they will not load the new ios on the 4th gen ipods, so i cannot update my apps or download many new ones as they are all built for the new operating system.
why should i pay £70 for a replacement that they have already deemed obsolete?!
Do i have any rights here?
Can i argue that its not fit or purpose, even though i bought it years ago?
As always, any advice is much appreciate

IMO, No you do not have any rights unless you can prove that it has an inherent fault {that I doubt}. Trying to argue that it is not fit for purpose would be countered with the fact you have had and used it for the last 4 years.0

The replacement will usually be with the most up to date version of the iPod, rather than like for like, so you might do a bit better out of it.0

I asked, but its not the most recent version.
it would be a refurbed 4th gen
(i agree, £70 for a new one would be a good deal!)
I suppose i feel annoyed that if i do buy a new one i'll be in the same situation in a few years!!
Looking at the apple website, they only offer apple care for three years, so perhaps even they don't expect them to last longer than 3 years0 -
Who did you buy the thing from?
You have up to six years to seek a remedy from the seller.
All you have to do is prove that the ipod is inherently faulty.

Of course if he cannot find anyone to provide that report, then it could reasonably be deduced that the problem is not due to an inherent fault.0
