My Jar (Text Loan( Default added 3 YEARS LATER - REMOVED !!!!!

Hi Everyone
I have seen posts from people who have discovered defaults they had not received on their credit files from My Jar formally text loans years after their accounts went into arrears.
Same happened with me but after a few emails they have agreed I can pay back the loan and they will remove the default from my file - RESULT!
Here is how I did it.
I asked why the company did not send to my home address. I know 100% they did not as I am fully on top of mail / finances.
They admitted they sent to the email address they had on file and the telephone number (both do not exist and haven't since late 2011)
They argued that they did not send to home address due to privacy ?? and it was my responsibility to update them with details.
They confirmed they did not register the default until 3 years after account went into arrears (not when account 3-6 months in arrears as in guidelines from ICO) and the reason for 3 years later is due to them not reporting to CRA back then but they are now !!
I spoke to FOC and they advised me to send a 'FORMAL COMPLAINT' and they have 8 weeks to respond with a 'FINAL RESPONSE' If they do not do what you ask then escalate to FOC.
My complaint was this:
1) In the credit agreement it is between My Jar (Text Loan) and me at my home address not my email address - no correspondence sent to home address which did not give me to opportunity to resolve the issue thus avoiding default.
2) There was a section I think 1.9 where is said any demands are to be sent to email OR home address (again they chose not to send to home address)
3) The ICO guidelines are that defaults are to be sent / dated 3-6 months from the time the account went into arrears - This was done 3 years later.
They responded to my formal complaint refusing to remove but did not confirm it was their 'Final Response'
I emailed bac asking if email was final response. I think panic started setting in then and they called me !!!! I said I am not communicating verbally, I need all comms. in writing.
I then followed this up with an email asking if last mail was their final response, they have 8 weeks to sent final response, pointed the facts of my complaint again.
Then next day BINGO. They offered to remove default if I pay original loan amount plus £17.00 interest which I have accepted.
If they had sent to my home address I believe I would of been OK to get the default date backdated to 2011 from 2014 so removed 2017 instead of 2020 !!! but I think I may of had trouble getting it removed (I would if tried other angles though)
Hope this helps others as I say ask them why they did not send to home address, if they say they only sent to email which you didn't receive you will probably be able to get it removed.

They have to be transparent and also I am sure the FOS would of backed me up which is why they caved and agreed to settle and remove.
I have seen several forums with people with same issue - terrible0
