BPA investigation about PCS "fronting" for the small fry , and adding large sums on
this is the proverbial ghost ticket followed up by a very inadequate NTK about 8 weeks later and offering a appeal via there website.

BPA – xxxxx.
I have received a response from the operator regarding your complaint. I have not yet concluded the investigation but I wanted to provide you with an update.
A company called Debt Recovery Plus dealt with your appeal on behalf of Greater London Keyholding. As my colleague Steve explained previously, this is not against our Code of Practice.
The Notice to Keeper you received should have contained the vehicle registration number. Debt Recovery Plus have confirmed this to be an admin error and to rectify this error, they have confirmed the parking charge notice will be cancelled.
The signage which displayed the incorrect company number has already been amended to reflect the correct information – this matter is now closed.
Greater London KeyHolding have confirmed company vehicles are not used to patrol the sites they manage. All sites are patrolled by foot and parking attendants are in full company uniform with the company logo on along with their ID badge. Any vehicle used to commute to the site will be a private vehicle used by the attendant. If you have evidence that this is not the case, we will be able to investigate the matter further. For the time being, this matter has been closed.
I am still investigating the issue regarding the website not allowing you to read the terms and conditions. Once I receive feedback on this I will update you further.

the end user did not know he was dealing with DR+ , all communications were from PCS
and , a higher bod at the BPA has already stated
"It is not within the remit of the BPA as a membership association, to monitor private parking operator’s websites and the information provided on these. "

yes , yes , yes , however they are trying to play NON POFA 2012 , with no intention of conforming to the BPA , how many times have we had posters on this forum with letters from PCS !
its took the BPA 9 weeks and endless emails to accept a quarter ogf the faults
PCS won,t get a bollocking , and will probably still charge GLKL for there "back office" services.0 -
That's true (about not even trying to comply with PoFA). They don't even bother to get them out on time.
The BPA should still come down on them like a ton of bricks for the £120 and the ghost ticket (but won't).Je suis Charlie.0 -

PoFA has nothing to do with it. It's a breach of the CoP not to offer a discounted payment, and by sending out the NtK (sort of) when there was no earlier windscreen ticket they have failed to offer a discount.
And £120 is an even more blatant breach. The CoP says categorically that the maximum is £100. All they can do between the (supposed) windscreen ticket and the NtK is increase it from the discounted rate to £100, they can't add extra on.Je suis Charlie.0 -

Thanks for your notes this morning.
I want Gemma to have another look at all of this please.
She will need some things from you if possible, if not she will get them from GLKL or PCS;
· A copy of the original ticket put on your screen – both sides please
· A copy of the NTK that you were issued with by PCS
· Copies of any additional correspondence that you have received from either party.
· Copies of any appeals made to them by you – we may already have some of them.
I will make some observations on the points that you have made;
· The £100 figure is not one set by Government – it is the maximum recommended figure in our Code – to set a figure would be fixing a price and not permissible under prevailing legislation.
· There are situations where the amount can rise above £100 and that’s why we need to see the paperwork
· There is no requirement in our Code of Practice that says the operator has to handle the appeal – please review Clause 22 of our Code which you can find at www.britishparking.co.uk
· Clause 22.6 talks about how cases should be put on hold while under appeal and we would need to review your paperwork against that Clause.
· Thanks for the picture of the sign – we will be checking that the operator has made the required changes – if he has, then this part of your case is closed – if not, disciplinary action may follow.
· Gemma will be handling this investigation and I will oversee it. Further correspondence should be sent to her please.
Please don’t forget to process your appeal to POPLA, this is the best way to get your ticket cancelled.
